I. Online Booking Process

Steps of booking through the online booking system:
1. The Client may choose from the Packages and standard accommodation offered as stated in the booking table.
2. On familiarisation with the Package and its price, the Client selects the time of stay for the selected room as well as additional terms or a Package.
3. On selection of an offer, the Client proceeds to a form, which needs to be completed by specifying the Client’s personal data and optional comments on the booking.
4. On completion of the form the Client makes an advance payment by one of the following methods:
* Credit card (Visa, Mastercard, Eurocard);
* Electronic bank transfer (EveryPay).
4a. Having selected one of the first two options the Client is directed to a page where payment can be made by means of EveryPay payment system. Authorisation starts upon connection to UAB Paysera LT through an encrypted 128 bit protocol. After EveryPay accepts the payment, the Client receives a confirmation of payment and booking by an automatic email message. The email message will specify the Client’s data, name of the hotel, total price of the accommodation, advance payment made and the remaining amount payable. The Client will pay the remaining amount upon arrival to the hotel. The email message confirming the booking has to be presented at the hotel as a proof of the advance payment and of the remaining amount payable.
4b. Having selected the third option (payment by bank transfer or later payment), the Client will receive a confirmation of initial booking, which will be finally confirmed upon making the advance payment by an ordinary bank transfer or online. The booking has the status of an initial booking 48 hours after its making and may be cancelled if no advance payment is received. On receipt of the advance payment, an email message confirming the booking is sent to the Client. The Client has to present the confirmation email to the hotel manager for final settlement.
4c. Client, who uses an account in the BookingRobot system has the ability to link his credit card (s) to the account. In this case, each time you purchase a hotel service, a monetary amount will be debited from the customer's credit account automatically, once, at the time of purchase. No additional payments are required. A card link can be canceled at any time in account settings, by pressing "Delete" button. The data security of the client’s credit cards is provided by UAB Paysera LT, accredited by the Lithuanian Bank.
5. The Client understands that, in case of a failure/programming error in the online booking system, the published price for the services is unreasonably low/high considering the content of the services; the hotel is entitled to notify the error to the Client within 10 days from the booking confirmation and request payment of the full price. Should the Client refuse to pay the full price, the hotel may cancel the contract/refuse to provide the services. In such a case, the hotel will not indemnify the Client for any losses.

Ia. Booking at Request
In cases where there are no rooms available online, the Client may be offered a room at the Client’s request. Upon completing the form, the Client receives an email confirmation of the time of stay (or information that no rooms are available) with the instructions for the making of the advance payment. The Client may make an advance payment by credit card or by an electronic or ordinary bank transfer. The booking will be confirmed upon receipt of the advance payment. Upon making the advance payment the Client will receive an email confirmation of the booking, which the Client has to present upon arrival to the hotel for final settlement.

II. Payment and Cancellation of Booking

1. The Client makes the advance payment by one of the three methods used by the system and pays the remaining amount upon arrival to the hotel.
2. There are no booking transaction costs for the Client.
3. In June - guests can cancel their reservation free of charge up to 3 days prior to arrival. The guest must pay in full at least 3 days before arrival.
July-August and the New Year period and during the Fish Festival Guests can cancel their reservation free of charge up to 7 days prior to arrival. The guest must pay in full at least 7 days before arrival.
Low season (September- May): Guests can cancel their reservation free of charge until 14:00 on the day of arrival. The first night's stay is charged if cancelled after 14:00 on the day of arrival.
4. If the reservation is canceled less than 24 hours before the arrival day by 3 PM or if the guest does not arrive at the hotel, the entire amount of the deposit is forfeited.
5. Should the Client change the booking details after making an online booking at a discount price of the Package offered by the hotel, the hotel is entitled to recalculate the full price of the order at the current prices.

III. Final Provisions

1. The Client is obliged to provide correct details in the booking form. The hotel is not liable for the wrongly chosen check-in or check-out dates or any other details wrongly specified by the Client.
2. Responsibility for the correct servicing of the payment for the online booking lies with UAB Paysera LT electronic payment system.
3 . The hotel and the company servicing online payments are not liable for unavailability of the system and other faults occurring for reasons beyond their control.

IV. Personal Data

Personal data protection management is carried out in accordance with the applicable privacy policy conditions and the laws of the Republic of Lithuania.

V. Confirmation of Acceptance of Terms and Conditions

By ticking ‘Accept Terms and Conditions’, the Client confirms that he/she understands and accepts the terms of conditions of the booking. The booking is not valid without such confirmation.

Disputes regarding improper execution or non-performance of the agreement are resolved out of court in accordance with the Consumer Rights Protection Law at the State Consumer Rights Protection Authority (A. Goštauto St. 12, Vilnius, email: tarnyba@vvtat.lt, tel. 2626760, www.vvtat.lt), as well as through the ODR platform at http://ec.europa.eu/odr/

This privacy policy is intended for the persons using MANA HOTELS accommodation, SPA, restaurant, conference room rent and other services, purchase the goods or visit the website https://manahotels.lt and the candidates participating in the selection procedure for the vacancies published by MANA HOTELS.

We draw Your attention, that The present Privacy Policy shall not apply when using the services or websites of other companies or other booking systems, such as www.booking.com for example.

We process your data if:

You use our services and goods or order MANA HOTELS services and goods for other persons;
You visit the website https://manahotels.lt;
You communicate with MANA HOTELS in any way or simply follow the activities of MANA HOTELS on social networks;
You provide your opinion about MANA HOTELS or provide MANA HOTELS evaluations on social media platforms;
You have given your consent to receive direct marketing messages or during data collection and you do not object to the processing of personal data for direct marketing purposes;
You participate in the selection process for open job positions;
You are buyers, business partners, employees, suppliers of MANA HOTELS.

Purposes of personal data processing

We process your personal data for the following purposes:

You are not obliged to provide us with any of your Personal Data, however, it is possible that in the absence of availability thereof, we will be unable to performs certain actions, e.g., provide services, sell goods or issue invoices.

What data may be colected

In order to ensure smooth service delivery, we may collect the following personal data about you:

Personal Identification Data: name, surname, date of birth, passport or ID card number, signature.

Contact Information: email address, phone number, address, country.

Payment Information: credit card number, account number.

Reservation Information: arrival and departure dates, room number, special requests (e.g., food preferences), discount code, reservation number, your habits related to the services provided by MANA HOTELS, information obtained from using hotel room key cards.

Additional Services Information: restaurant reservations, spa appointments, sleep tracking, health monitoring and medical procedures, data about your health condition.

Communication Information: your reviews and opinions provided on social media, emails, messages and their records, videos, your profile and other information on social media.

Other Information You Voluntarily Provide: opinion surveys, service inquiries, etc.

Marketing and Preferences: newsletter subscriptions, promotional offers.

Cookies and Analytics: IP address, browsing habits, history and dates of visiting our website.

How we colect data

Directly from You, when:

You fill out inquiry or reservation forms on the website;

You send your resume (CV) or other employment-related information;

You place an order for services provided by MANA HOTELS;

You contact MANA HOTELS in another way;

You communicate with MANA HOTELS through social media or simply follow MANA HOTELS activities on social networks;

You use MANA HOTELS hotel room key cards;

MANA HOTELS provides services to you.

Through the online booking channel you use to make reservations, such as www.booking.com and others;

From your travel agent or another person who books services provided by MANA HOTELS for you;

From social media platforms or online reviews;

From MANA HOTELS group companies;

From MANA HOTELS data processors or other external sources.

Personal data may be collected when you use or inquire about services, such as when you make a phone call, send a text message, email, order services or goods, or visit our website.

Legal basis for processing

Contractual Necessity: Processing is necessary to perform our contract with you (e.g., booking and managing your stay).
Consent: Where you have given clear consent for us to process your personal data for a specific purpose (e.g., marketing communications).
Legal Obligations: Compliance with our legal obligations (e.g., financial record-keeping).
Legitimate Interests: Processing is necessary for our legitimate interests (e.g., improving our services).

We are committed to processing personal data fairly and lawfully, ensuring that it is processed only for the purposes for which it was collected, and that it is processed in accordance with the clear and transparent principles and requirements of personal data processing as established by law.

Should we disclose your personal data to the data recipient groups other than those indicated in the present Privacy Policy, we will notify you about it no later than upon the first disclosure of the data, except in cases where such information has already been presented to you in other documents provided or documented concluded with you.

Sharing personal data and transferring it to third parties

We respect your privacy and therefore inform you that we may share your personal data without your consent with:

Service Providers: Third parties providing services such as payment administration, auditing and consulting, IT support and marketing, as well as online booking channels you use to make reservations, such as www.booking.com, your travel agent or another person who books our services for you, and legal service providers.

Law Enforcement and Government Authorities: Law enforcement agencies, government institutions, and other entities entitled to receive such data from us in accordance with the laws of the Republic of Lithuania.

MANA HOTELS Group Companies and Partners: Only in accordance with this Privacy Policy and solely to facilitate your service booking.

If we disclose your personal data to other groups of recipients not specified in this Privacy Policy, we will inform you no later than at the time of the first disclosure of the data, unless we have already provided you with such information earlier in other documents provided to you or entered into with you.

Personal Data processing Periods

Personal data is processed no longer than necessary to achieve the purposes for which it was collected, or as required by data subjects and/or provided by law.

Generally, we will process data during the contract, service provision, and for 10 years from the end of the contract, service provision, or the end of the relationship, to comply with archiving requirements set by law and to assert, exercise, or defend legal claims of MANA HOTELS.

For direct marketing purposes, based on the data subject's consent, MANA HOTELS processes personal data from the receipt of consent for no longer than 5 years or until the data subject withdraws their consent.

For direct marketing purposes, when providing you with notifications about similar MANA HOTELS goods or services based on legitimate interest, MANA HOTELS processes personal data during the validity of the contract with you and for 3 years after the end of the contract or the purchase of goods/services (in the case of a one-time purchase) or until you object to receiving such notifications from MANA HOTELS.

Candidate data submitted for a specific selection process, where no employment contract is concluded, or if the candidate submits their data without applying for a specific position at MANA HOTELS, is stored with the candidate's consent for 1 year or until the candidate withdraws their consent.

Recordings of telephone conversations made for service improvement purposes are stored by MANA HOTELS for no longer than 14 days.

Data collected during guest behavior monitoring for service improvement and customization to guest needs is processed by MANA HOTELS for no longer than 3 years from the last contact with the client.

Payment card data is stored for 4 days after departure.

Your personal data obtained through social media platforms or online reviews to address your complaints or respond to positive feedback, to monitor our reputation online, and to evaluate and improve service quality, is processed by MANA HOTELS for no longer than 1 year from the collection of such data.

Video surveillance footage with personal data and personal data obtained using a lock card are stored and processed for no longer than 1 month from the date of recording/receipt.

Health status data is stored for the period provided by law. Data about your sleep, which is not included in the medical record, is deleted immediately after the service is provided.

If you withdraw your consent for data processing or the data processing period expires (when data is processed based on your consent), only data confirming the fact of your consent is stored, but no longer than 10 years from the end of the consent period or the withdrawal of consent, to assert, exercise, or defend legal claims of MANA HOTELS.

Your personal data obtained for the implementation of COVID-19 (coronavirus infection) prevention and control measures as instructed by the Ministry of Health of the Republic of Lithuania is stored and processed for no longer than 21 days from the date of recording/receipt.

Processing of health related data

In order to properly provide you with the wellness services, we process your special category personal data - data about your health condition. Your health information received for the purposes indicated herein shall be kept confidential and shall not be shared with other persons.

Data Processing Related to Payment Collection

To ensure that you pay for our services, we:

Utilize the services of payment collection providers. For this purpose, we provide your identification data, order details, and email information to these providers, who send an invoice with a payment link to your email address.

Collect your credit/debit card information. Upon receiving your credit/debit card details, we verify your credit limit.

We process data related to payment collection solely for the purpose of securing payment for services (our legitimate interest).

If you cancel or modify your order or under other conditions requiring refunds, we will refund your money directly through a commercial bank.

Video Recording for Property and Personal Protection and Theft Prevention

We conduct video surveillance in our hotels to protect our property, your property, and the property of others, as well as the health and lives of individuals, based on the legitimate interest of MANA HOTELS and third parties.

During video surveillance, we collect the following information: video recordings, the date and time of the recordings, and location.

We organize video surveillance in such a way that the surveillance area is limited to the necessary territory (room, part of a room) of our hotels. The interior of our hotel premises and entrances to the hotel are monitored.

Video surveillance is not conducted in areas intended for private use, such as toilets, showers, changing rooms, and hotel rooms.

Video recordings may only be used to detect suspected criminal activities, administrative offenses, or to prove, disclose, and defend damages to MANA HOTELS employees, service providers, third parties' property, or MANA HOTELS property, health, or lives. They may only be transferred to individuals entitled to receive such data by law.

Video recordings are provided only to the police.

Processing of Data Obtained from Lock Cards for Property and Personal Protection, Theft Prevention

To ensure your visit to MANA HOTELS is safe, MANA HOTELS conducts access control for property and personal protection and theft prevention purposes. Access control is conducted using the room lock card and code issued by MANA HOTELS.

The room lock card and code record your entry/exit from the MANA HOTELS hotel room. During your stay, we assign you a lock card and code number and set its validity period.

Data obtained from the use of the room lock card and code may only be used to detect suspected criminal activities, administrative offenses, or to prove, disclose, and defend damages to MANA HOTELS employees, service providers, third parties' property, or MANA HOTELS property, health, or lives. They may only be transferred to individuals entitled to receive such data by law.

Data Processing for Direct Marketing Purposes

By providing us with your name, surname, email address, or phone number, you can agree or disagree that this data is used for direct marketing purposes.

When processing your personal data for direct marketing purposes, we may also obtain information about whether our newsletter was read: when and how many times it was opened or if any links were clicked.

With your consent, we will send you information about services and goods offered by MANA HOTELS and other related companies.

If you have already purchased goods or reserved/ordered services from us, or if you have entered into a contract with us and did not object to the processing of your personal data for direct marketing purposes at the time of data collection, we will process your data based on legitimate interest by sending you notifications about similar goods or services. MANA HOTELS Hotel Rating and Guest Review Analysis and Complaint Handling for Service Improvement Purposes

MANA HOTELS may process your personal data obtained through social media platforms (such as Facebook, Instagram, LinkedIn, Tik Tok, and others) or online reviews (e.g., TripAdvisor) to examine your complaints or respond to positive feedback about us, monitor our online reputation, and evaluate and improve the quality of our services. For the purposes specified in this section, we process your personal data based on the legitimate interest of MANA HOTELS.

For the purpose specified in this section, we may process your personal data that you share with us or publish on social media or in other online reviews about us.

Monitoring and Analysis of Your Behavior for Service Improvement Purposes

When you stay at MANA HOTELS, we process your name, surname, the number of times you have stayed at MANA HOTELS, the dates, the price paid for services, what you ordered to your hotel room, and any additional services you ordered. We process this data to evaluate and improve the quality of our services and to offer you tailored services the next time you stay at MANA HOTELS. For the purposes specified in this section, we process your personal data based on the legitimate interest of MANA HOTELS.

Personal Data Processing for Gift Voucher Purchase

We process your name, surname, information about the service/product indicated on the voucher, your email address, the validity date of the gift voucher, and payment details when you purchase a gift voucher. If you buy a gift voucher for another person, we also process the recipient's name.

Personal Data Processing for Employment at MANA HOTELS

Potential MANA HOTELS employees (candidates, job seekers) provide MANA HOTELS with the following personal data: resume, name, surname, phone number, email address. We will inform you about the processing and retention periods of your personal data as a potential employee during the first contact, either verbally or via email. You can find information on how we process your personal data as a potential employee in this Privacy Policy section.

When contacting MANA HOTELS through social media platforms, e.g., LinkedIn, the social network operator may process your interest in MANA HOTELS job postings according to the policies of the social network operator.

Your personal data submitted when applying for a specific position at MANA HOTELS is processed for the purpose of concluding an employment contract with you as a potential employee.

If you apply for a specific position but are not offered the job, your personal data will be destroyed at the end of the selection process, unless you provide consent to retain your personal data for future MANA HOTELS employee selections. You can withdraw your consent for personal data processing for the purpose specified in this Privacy Policy section at any time by clearly and unambiguously expressing your will in writing to a MANA HOTELS employee, by contacting MANA HOTELS by phone or email.

Personal Data Processing Related to COVID-19 Restrictions

If you visit MANA HOTELS restaurants, we process your personal data, including your name, surname, and phone number. These data are processed under the instructions of the Ministry of Health of the Republic of Lithuania for the purposes of COVID-19 (coronavirus infection) prevention and control measures. If you do not agree to the processing of your personal data, you will not be allowed to enter MANA HOTELS restaurants.

Data Processors

Your personal data may be processed by data processors providing accounting, legal, website hosting, data center and/or server rental, IT maintenance, external audit, and other services to MANA HOTELS, as well as by managers of hotel management systems and hotel booking systems.

Data processors have the right to process personal data only according to MANA HOTELS instructions and only to the extent necessary to properly fulfill the obligations specified in the contract. MANA HOTELS, engaging data processors, aims to ensure that data processors have implemented appropriate organizational and technical measures to ensure security and maintain the confidentiality of personal data.

Joint Data Controllers

Your personal data may be processed not only by the data controllers specified in this Privacy Policy but also by other data controllers (i.e., joint data controllers as understood in Article 26 of the Regulation), such as other companies in the MANA HOTELS group.

We have agreements with joint data controllers, the main terms of which you have the right to review by contacting MANA HOTELS. Upon your request, we will provide you with the contact information of joint data controllers.

When your data is processed jointly with other data controllers, you can exercise your rights as established in the Regulation concerning each of the joint data controllers.

Your Rights Regarding Personal Data

Your rights regarding personal data include:

Right to be informed about the processing of your personal data:

When we collect personal data directly from you, we inform you at the time of data collection:
Verbally (if we communicate with you verbally, e.g., by phone);
In writing (information sent by email is considered provided in writing).

If we obtain your data from sources other than you, we will inform you about the processing of your personal data verbally or in writing (as mentioned above) no later than one month from receiving the data, or if your personal data will be used to contact you, no later than at the first contact.

Right to access your processed personal data and how it is processed:

You have the right to receive information about the retention period of your personal data, the sources from which the data were collected, the purpose of the processing, and to whom the data are disclosed. Upon receiving your request, we will promptly, but no later than one month from the receipt of the request, check whether and what personal data of yours are being processed by MANA HOTELS. If we find that we process your personal data, we will provide you with information about the processed personal data and a copy of the processed personal data in electronic or paper format.

We may extend the period for providing a response if necessary, considering the complexity and number of your requests. We will inform you separately about any such extension. If we decide to extend the response period, you have the right to contact the State Data Protection Inspectorate.

Typically, we provide information to you free of charge. However, if your requests are clearly unfounded or disproportionate, particularly due to their repetitive nature, or if you request a copy of the processed personal data in a format other than the electronic or paper format prepared by MANA HOTELS, we may charge a fee covering the administrative costs incurred by MANA HOTELS for providing the information or taking the requested actions.

Additionally, if your requests are clearly unfounded or disproportionate, we have the right to refuse to act on your request.

Upon your request, information can be provided verbally, by allowing access to the document, providing a certificate, an extract of the document, a paper copy of the document, an electronic medium, or access to the information file. If you do not specify the format for providing the information in your request, we will provide the information in the same format as the request received.

Right to request correction of personal data and to suspend data processing if you determine that the data is incorrect, incomplete, or inaccurate after reviewing your personal data:

In such cases, MANA HOTELS will promptly inform you of the correction, destruction, or suspension of the processing of personal data performed or not performed at your request. We will also inform data recipients of the correction or destruction of personal data or the suspension of data processing performed at your request, except where it is impossible or overly burdensome to provide such information. In such cases, we will provide you with information about those data recipients at your request.

Right to request the destruction of personal data or to restrict data processing if, upon reviewing your personal data, you determine that the personal data are processed unlawfully or unfairly:

MANA HOTELS will promptly inform you of the restriction of data processing performed or not performed at your request. Restricted personal data are stored. Before lifting the restriction, we will inform you of this using electronic communication means. We will also inform data recipients of the restriction of data processing at your request unless it is impossible or overly burdensome to provide such information. In such cases, we will provide you with information about those data recipients at your request.

Right to object to the processing of your personal data, except when such personal data are processed for legitimate interests pursued by the data controller or a third party to whom the personal data are disclosed, and if the data subject's interests are not overriding:

If you object to the processing of personal data, further data processing is carried out only if it is motivatedly determined that the reasons for processing the personal data outweigh your interests, rights, and freedoms, or if the personal data are necessary for establishing, exercising, or defending legal claims.

Right to object to the processing of personal data for direct marketing purposes:

Right to withdraw consent for data processing:

You have the right to withdraw all your consents for the processing of personal data at any time when the basis for processing your personal data is your consent provided to MANA HOTELS.

Right to request data erasure (right to be forgotten):

You have the right to request that MANA HOTELS erases personal data related to you for the reasons specified in Article 1 of the Regulation.

We have the right to refuse to fulfill your request in cases specified by law, including but not limited to cases discussed in Article 17(3) of the Regulation.

If we fulfill your request and your personal data (erased upon your request) were transferred to data recipients, we will inform those data recipients unless it is impossible or overly burdensome to provide such information. At your request, we will provide information about those data recipients. This right cannot be exercised if we are required by law to retain personal data.

Right to data portability:

You have the right to request that the personal data you provided, if processed based on consent or a contract and if processed by automated means, be transferred to another data controller or provided to you in a structured, commonly used, and machine-readable format if technically feasible. When exercising your right to data portability, you must specify whether you prefer the personal data to be transferred to you or another data controller.

If we fulfill your request and you wish the data to be provided on a digital medium, we will provide you with the personal data processed by MANA HOTELS on a one-time recording CD provided by you, or on a one-time recording CD provided by MANA HOTELS, with you compensating the cost of the medium.

You do not have the right to data portability for personal data processed non-automatically in structured files, such as paper files.

Transferred personal data are not automatically deleted. If you wish for the data to be deleted, you must contact MANA HOTELS to exercise your right to request data erasure (right to be forgotten).

Right to object to being subject to solely automated data processing, including profiling:

You have the right to know and be informed about the logic involved in automated processing and the possible consequences of such data processing when the data are processed solely by automated means.

When you request a review of a decision based on automated data processing (if such decisions are made by MANA HOTELS concerning you), we will conduct a thorough evaluation of all relevant data, including the information you provided.

Right to lodge a complaint with the State Data Protection Inspectorate or a competent court regarding personal data processing:

You can lodge a complaint with the State Data Protection Inspectorate, located at A. Juozapavičiaus g. 6, Vilnius, email address ada@ada.lt, website www.ada.lt, or a competent court of the Republic of Lithuania concerning our actions or inactions related to the exercise of data subject rights. If you choose to exercise your rights through a representative, the representative's request must include their name, surname, address, and other contact details for communication, as well as your name, surname, and other necessary data for proper identification of the data subject, and provide a document or its copy confirming the representation.

For all matters related to the processing of your personal data and exercising your rights, you have the right to contact the MANA HOTELS Data Protection Officer.
